One of the topics that our foreign investors are concerned about is employment. Employment in Korea is subject to local labor-related laws and regulations, such as the Labor Standard Act and Minimum Wage Act, irrespective of whether the employee is a foreigner or the employment is part-time or fixed-term.<\/p>\r\n

The labor laws of Korea favor employees compared to those of the U.S., at least in the area of employment termination.<\/p>\r\n

In the State of New York, as in most U.S. states, employment is generally \u201cat-will,\u201d meaning that either the employer or the employee can terminate the employment relationship at any time, for any reason, or no reason at all, as long as the reason is not illegal (e.g., discrimination, retaliation, violation of public policy, breach of contract, and constructive discharge).<\/p>\r\n

In contrast, the labor laws of Korea require employers to have \u201cjustifiable cause\u201d to terminate an employment relationship. The standard of review for a justifiable cause is relatively high. For example, the courts will find a justifiable cause where the employee\u2019s conduct amounts to criminal acts against the company, such as embezzlement, breach of trust, theft, or causing a severe accident due to negligence. If insubordination is asserted as grounds for termination, the order that was not followed has to be justifiable. Moreover, employers must provide 30 days\u2019 notice or pay in lieu of notice before terminating an employee, a protection not typically found in the State of New York.<\/p>\r\n

Per the FLSA (Fair Labor Standard Act), the standard workweek in the U.S. is 40 hours, and any hours worked beyond that must be compensated as overtime at a rate of 1.5 times the regular pay in general. In the State of New York, the ten-hour rule would apply in addition to the overtime payment. However, no federal or state regulations generally cap the total hours an employee can work per week, except for limited exceptions, such as the 24-hour break rule, which applies only to specific industry sectors.<\/p>\r\n

In contrast, Korea has a legal cap on the workweek, set at 52 hours (40 regular hours and up to 12 hours of overtime). Employers cannot require employees to work more than this without facing legal consequences unless an exception applies. Overtime pay is also at least 1.5 times the regular wage, with additional premiums for night work and holidays.<\/p>\r\n

In the U.S., generally speaking, no federal laws mandate paid vacation or sick leave for employees. The FMLA (Family and Medical Leave Act) does provide job-protected leave for certain family and medical reasons; however, this leave is generally unpaid. Some states and localities have their own laws requiring paid sick leave or paid family and medical leave. However, these requirements vary widely by jurisdiction. The State of New York requires certain employers to provide paid sick leave depending on the size and net income of the company.<\/p>\r\n

In contrast, the labor laws of Korea mandate at least 15 days of paid annual leave after one year of employment, with the number of leave days increasing with longer service. This is significantly more generous than the leave policies in the U.S. The labor laws also provide paid maternity leave, with a portion paid by the government, and paid parental leave, allowing both parents to take time off work to care for their child. Ironically, however, Korea\u2019s population is declining, while the U.S. continues to experience moderate population growth.<\/p>\r\n
